Recommendation for Dismissal

Pursuant to SEC Rule 189-2-.03(5), it is recommended that his matter be administratively dismissed because the evidence does not support finding a violation of the Ethics in Government Act (Act). The allegations and findings are summarized herein.


On January 22, 2008, Respondent paid $450 in late fees and thereby eliminated any outstanding debt with the Commission. Unaware of this fact, the Commission voted on January 24, 2008, to open a Probable Cause investigation on Respondent for having unpaid late fees. However, in light of the fact that Respondent satisfied his debt of late fees prior to the Commission’s findings of Probable Cause at the January 24, 2008, Commission Meeting, this matter should be administratively dismissed.


Based upon the foregoing analysis, Commission it is recommended that this case be administratively dismissed pursuant to SEC Rule 189-2-.03(5).
