Non-Candidate Committees (sometimes called “Other Than Candidate Committees”)
Political Action Committees – Any committee, club, association, partnership, corporation, labor union, or other group of persons which receives donations aggregating in excess of $1,000 during a calendar year from persons who are members or supporters of the committee and which distributes these funds as contributors to one or more candidates for public office or campaign committees of candidates for public office. Such term does not mean a campaign committee.
Independent Committees – Any committee, club, association, partnership, corporation, labor union, or other group of persons, other than a campaign committee, political party, or political action committee, which receives donations during a calendar year from persons who are members or supporters of the committee and which expends such funds either for the purpose of affecting the outcome of an election for any elected office or to advocate the election or defeat of any particular candidate. An independent committee is one that makes “independent expenditures”
Independent Expenditure – An independent expenditure is an expenditure for a communication which expressly advocates the election or defeat of a clearly identified candidate of which is made independently of any candidates campaign. An expenditure is “independent” only if it meets certain conditions. It must not be made with the cooperation or consent of, or in consultation with, or at the request or suggestion of any candidate or any of his or her agents or authorized committees. And expenditure which does not meet the above criteria for independence is considered a contribution which is subject to limits.
Recall Committees – Any campaign committee which accepts contributions or makes expenditures designed to bring about the recall of a public officer or to oppose the recall of a public officer.
Ballot Committees – Any campaign committee which accepts contributions or makes expenditures designed to influence the passage of any statewide referendum, constitutional amendment, or ballot question in any county or municipal election.
